NEWS:- OCI in lieu of PIO Card

The PIO card scheme has been withdrawn vide Gazette Notification No. 25024/9/2014 F.I dated January 09, 2015. Further, vide Gazette Notification No 26011/01/2014IC.I dated 09.01.2015, all existing PIO card holders are deemed to be OCI card holders.  Henceforth, applicants may apply for OCI Card only, as PIO Card scheme is no longer in existence. Now, it has been decided to extend the date for submission of the application for registration as OCI card holder by the erstwhile PIO cardholder till 30.06.2017.   All PIO card holders are strongly encouraged to apply for OCI in Lieu of PIO card before 30.06.2017 on GRATIS basis.


Overseas Citizen of India (OCI) Scheme

New instructions w.e.f 23 November, 2015

Ministry of Home Affairs, Govt. of India has issued new instructions relating to online submission and processing of applications for registration as OCI Cardholder and for OCI Miscellaneous services. The details are as follows:

  1. The applicants shall henceforth submit the application form online and online upload all the requisite documents (self-attested), photograph and signature (in the case of minors who cannot sign, left hand thumb impression for boy and right hand thumb impression for girls) along with the application.
  1.  These changes in the OCI registration process are effective from 23 November, 2015 and thereafter no application for registration as OCI cardholder or for OCI miscellaneous service will be accepted or processed in the offline mode.


OCI Registration Process

Application form for OCI registration needs to be filled online at https://passport.gov.in/oci

  • There are three distinct options namely, (i) OCI Registration Form for fresh applicants/ first timers, (ii) OCI Registration Form for OCI in lieu of PIO and (iii) OCI Miscellaneous Registration Form for existing OCI card holders in case of change of Passport particulars, personal particulars, loss/ damage of OCI etc.
  • After filling the form, the applicant need to save and print the form. A reference number is generated on the printed form. Also please online upload required documents.
  •  This printed form along with the self attested required documents as mentioned below should be submitted at the Consular Wing, Embassy of India, Budapest, Hungary on working days from Monday to Thursday between 1000 Hrs to 1200 hrs along with the relevant fee as mentioned below. Documentation required

After online submission of OCI application and online uploading the required document,   Print out of the OCI application, Self-attested photocopies of required documents and photographs have to be submitted to the Indian Mission  along with the originals  supporting documents for  verification and return.  Apostilled documents can be accepted only if the applicants are unable to produce original documents.

Adult applicants (Indian Origin/Having Indian passport in past)

  • OCI Registration Form (part A&B duly filled online and signed by the applicant)
  • Three recent photographs of the size of 5×5 cm without border and showing full frontal view of applicant’s head/shoulder, white/light background. No glare if wearing glasses
  • Copy of Cancelled Indian passport.
  • Passport surrender certificate /renunciation of Indian citizenship certificate.
  • Copy of the Hungarian/Bosnian passport.
  • Copy of the Naturalization certificate issued from Hungarian/Bosnian Government.
  • Name change deed from solicitor/oath commissioner/local administration should be submitted in case of name/surname change, change of appearance
  • Marriage certificate needs to be submitted in case of change of name after marriage.
  • Copy of Hungarian/Bosnian Identity and Address card.

Foreign spouse of Indian national/Overseas Citizen of India

  • OCI Registration Form (part A& B duly filled online and signed by the applicant)
  • Three recent photographs of the size of 5×5 cm without border and showing full frontal view of applicant’s head/shoulder, white/light background. No glare if wearing glasses.
  • Copy of the Hungarian/Bosnian passport.
  • Copy of Indian passport of spouse.
  • Copy of OCI Card of spouse .
  • Marriage certificate, marriage should have subsisted at least two years at the time of submission of the application for OCI registration in respect of the foreign spouse.
  • An affidavit to the effect that the Indian/OCI spouse is still alive and that the couple are not separated/divorced
  • Name change deed from solicitor/oath commissioner/local administration should be submitted in case of name/surname change, change of appearance
  • Copy of Hungarian/Bosnian Identity and Address card.

Minor children

  • OCI Registration Form (part A&B duly filled online and signed by the applicant). If minors are not capable of writing then it should have LTI in respect of girl child and RTI in respect of boy child. The From B in respect of minors is to be countersigned by both parents.
  • Three recent photographs of the size of 5×5 cm without border and showing full frontal view of applicant’s head/shoulder, white/light background. No glare if wearing glasses.
  • Copy of Hungarian/Bosnian passport.
  • Passport surrender certificate /renunciation of Indian citizenship certificate.
  • Copy of the OCI card, Indian Passport/Passport surrender certificate /renunciation of Indian citizenship certificate of the parents
  • Copy of the minor’s Birth certificate containing names of both parents
  • Marriage certificate of the parents
  • Copy of the Naturalisation certificate.
  • Copy of Hungarian/Bosnian Identity and Address card.

OCI Card in lieu of PIO  (Current PIO cardholders may apply for OCI cards in lieu of their  PIO cards till 30.06.2017.)

  • OCI Registration Form (part A& B duly filled online and signed by the applicant)
  • Three recent photographs of the size of 5×5 cm without border and showing full frontal view of applicant’s head/shoulder, white/light background. No glare if wearing glasses.
  • Copy of the valid PIO card
  • Copy of the Hungarian/Bosnian passport
  • Copy of Proof of OCI status/Indian nationality of Spouse/Parent.
  • Name change deed from solicitor/oath commissioner/local administration should be submitted in case of name/surname change, change of appearance.
  • Copy of Hungarian/Bosnian Identity and Address card.

OCI Miscellaneous Services

  • OCI Miscellaneous Registration Form (part A& B duly filled online and signed by the applicant) for change of Passport particulars, personal particulars, loss/ damage of OCI etc.
  • The applicants should fill up new passport number not old passport number while applying for transfer of OCI visa sticker from old passport to new passport
  • Three recent photographs of the size of 5×5 cm without border and showing full frontal view of applicant’s head/shoulder, white/light background. No glare if wearing glasses.
  • Copy of the new Hungarian/Bosnian passport
  • Copy of the previous OCI Visa sticker and the OCI booklet (the first and the last page)
  • Name change deed from solicitor/oath commissioner/local administration should be submitted in case of name/surname change, change of appearance etc.
  • Copy of Hungarian/Bosnian Identity and Address card.

OCI Fee Structure: The fee is accepted in Hungarian Forint  and in cash only at the Consular section of the Embassy of India; no Credit cards or other payment cards are accepted. 

  • Fresh OCI card application – Dollar 275
  • OCI in lieu of PIO – GRATIS (However, SMS/Fax/ICWF charges, as applicable, will be levied on the applicant.)
  • OCI Miscellaneous services – Dollar 25
  • Duplicate OCI in case of loss/damage-  Dollar 100

Note: A Consular Surcharge of HUF 450 is levied on all types of OCI applications.

Dispensation of the OCI services

OCI card is issued normally after 45 days from the date of submission of application subject to its receipt from the Ministry. OCI Cards for Foreign spouses of Indian national take about 3 months. OCI Miscellaneous services take about 3-4 weeks. Applicants are advised to check the status of their applications online.

 

Person of Indian Origin (PIO) Card Scheme

Rules/Regulations for OCI Card

Information on procedure for applying online for Indian descent under Section 4(1) of the Citizenship Act 1955:In order to make the procedure for acquisition of India citizenship simpler, faster and transparent, the Ministry of Home Affairs have introduced a new procedure for applying online for Indian Citizenship under Section 4(1) of the Citizenship Act, 1955.Applicants preferring application for Indian Citizenship by descent under Section 4(1) of the Indian Citizenship Act, 1955 is to be submitted to the concerned Indian Mission / Post where the child was born. If the application is made within one year of his/her birth in the prescribed form to the Mission/Post, then the Mission/Post shall provide the Indian citizenship on their own. In case the application is made after one year in the Indian Mission/Post abroad, then the applicatin is to be sent to the Ministry of Home Affairs for their approval. 3rd Feb 2015 Notice:
Modification of the OCI card scheme – Dispensing with ‘U’ Visa sticker

5th June 2015 Notice: Submission of application for OCI card in lieu of PIO cards is voluntary and optional. OCI card in lieu of PIO card can be applied at https://passport.gov.in/oci . All extant PIO cards will continue to be valid until further notice.


8th June 2015 Notice:

  • Registration as OCI cardholder in lieu of PIO card online, the date for submission of online applications by the erstwhile PIO cardholders with valid PIO cards as on 9.1.2015 has been extended till 30.09.2015.
  • The OCI card is a smart card which will facilitate quicker immigration clearance at the ICPs and also for obtaining various Consular services from the Indian Missions. For those residing in India, it will facilitate in availing various services in India.
  • The applicants may submit the application for OCI card in lieu of PIO card to the Indian Mission/FRRO concerned within the jurisdiction of their place of residence. This is in modification to earlier rules that the application could be made only at the location where the PIO card was given.
  • In cases of erstwhile PIO cardholders, the new foreign passport number may continue to be endorsed on the existing PIO card till the person concerned is issued an OCI card in lieu of the PIO card.
  • Conversion of PIO card to OCI in respect of spouse of foreign origin of citizen of India or spouse of foreign origin of an OCI cardholder registered under section 7A of the Citizenship Act. 1995: The person concerned should submit the applications online in teh format prescribed and thereafter the Indian Mission/Post/FRRO may process the applications as in the case of other applications for the grant of OCI card in lieu of PIO card. In these cases prior clearance of MHA may not be necessary since the PIO card is being replaced by the OCI card. No offline applications shall be accepted.
  • Grant of OCI card to the foreign nationals whose Indian spouse is no more has been reconsidered: Applications for grant of OCI card in these cases may be accepted by the Indian Missions/Posts/FRROs and decision taken on case to case basis, subject to the condition that the foreign spouse has not re-married another foreigner. In case the foreign national gets married to another foreigner the OCI card will be immediately cancelled. In case of re-marriage to another citizen of India or an OCI cardholder, the person concerned will have to submit fresh application for grant of OCI card.
  • The foreign national children of such Indian national who is no more will be entitled to OCI card as per section 7A of the Citizenship Act, 1995 on the basis of their Indian origin. Such children holding PIO card will also be eligible to apply for OCI card in lieu of the PIO card.
  • The foreign national spouse of a PIO/OCI Cardholder, whose parents/grandparends are/were of Indian origin will also be eligible for OCI card as per section 7A of the Citizenship Act 1995 based on his/her Indian origin.
  • In respect of cases where the marriage has been subsisting for long, but registered only at the time of submission of OCI application, the marriage certificates may be accepted and the issue of OCI card processed with reference to the date of marriage mentioned in the Certificate. However in case of any doubt, the same may be taken up by the issuing authority with the authority who has issued the Marriage Certificate for verification.
  • A person holding any type of Visa with 3 months validity as on the date of application for OCI card can submit his/her application for registration as OCI cardholder.
  • In cases the PIO card is reported to be lost, the fee for replacement will have to be paid. It has been decided to fix the fee in such cases as Rs.5500/- till further.
  • No fee will be levied in cases where the applciant wishes to change the personal particulars viz. passport particulars, address, occupation, etc while submitting the application for OCI card in lieu of PIO card.
